1 · who we are

weatherbox is published by cineviv ("we", "us"). You can reach us at info@cineviv.com.

2 · your licence to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use weatherbox on devices that you own or control, for your own non-commercial use. This licence is granted to you and not to anyone else, and it does not transfer ownership of anything.

Where you obtained the app through the Apple App Store, this licence is further limited to use on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Service.

3 · what you may not do

• Copy, redistribute, sell, rent, lease or sublicense the app.
• Reverse-engineer, decompile or disassemble the app, or attempt to derive its source code, except to the extent that applicable law expressly permits this despite this restriction.
• Remove, obscure or alter any proprietary notice in the app.
• Use automated means to scrape, harvest or bulk-download the weather data the app retrieves, or to place unreasonable load on our servers.
• Use the app to build or train a competing product or dataset.
• Use the app in any way that breaks the law, or that interferes with anyone else's use of it.

4 · the weather data, and what it is not

weatherbox presents forecasts and climate statistics derived from public meteorological sources, including the Global Forecast System operated by the United States National Oceanic and Atmospheric Administration and the ERA5 and ERA5-Land reanalyses produced by the European Centre for Medium-Range Weather Forecasts and distributed through the Copernicus Climate Change Service. We process that data; we do not observe or measure the weather ourselves.

Total Temp and the thermal forces are a model, not a measurement. They are our own apparent-temperature metrics, computed from meteorological inputs to describe how conditions may feel to a person. They are not a reading from any instrument, they are not a medical or physiological assessment, and different people in the same conditions will experience them differently.

Weather forecasts are inherently uncertain, and climate normals describe the past rather than predicting the future. Do not rely on weatherbox where an error could cause harm. For decisions involving safety — including aviation, marine navigation, severe weather, wildfire, flooding, mountaineering, construction, agriculture, or the health of people or animals — consult your official national meteorological service and the emergency authorities in your area. weatherbox is not a warning system and does not deliver official alerts.

5 · availability

We provide weatherbox on a best-effort basis. We may change, suspend or discontinue the app or any part of it, and we may stop publishing data or supporting older versions, at any time and without notice. Weather data may be delayed, incomplete or unavailable for some places or some periods. Some places are served from the nearest cell for which data exists, which may differ from your exact location.

6 · your device and your data

Your saved places and preferences are stored on your device, not on our servers. We cannot recover them for you. Uninstalling the app, clearing its storage, or losing or replacing your device will delete them permanently.

Our handling of information is described in our Privacy Policy, which forms part of these terms.

7 · ownership

The app, its design, its interface, the weatherbox name and mark, and the apparent-temperature model and colour system it embodies remain our property or that of our licensors. Nothing in these terms transfers any intellectual property right to you. Underlying meteorological data remains subject to the terms of the organisations that produce it.

8 · third-party services

The app retrieves data over the internet through third-party infrastructure, including content delivery and hosting providers. Their handling of the technical information that accompanies a network request is governed by their own terms and privacy policies, not ours.

9 · disclaimer of warranties

The app and all data in it are provided "as is" and "as available", without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, and uninterrupted or error-free operation. We do not warrant that any forecast, climate statistic or derived metric is accurate, complete or current.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Nothing in these terms limits any right you have under consumer protection law that cannot be limited by agreement.

10 · limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or opportunity, arising out of or in connection with your use of or inability to use the app, whether based in contract, tort, negligence, strict liability or any other theory, and whether or not we were advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the app will not exceed the greater of the amount you paid us for it in the twelve months before the claim, or ten United States dollars.

11 · indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss or expense, including reasonable legal fees, arising from your misuse of the app or your breach of these terms.

12 · Apple App Store

If you obtained weatherbox from the Apple App Store, the following applies:

• These terms are between you and cineviv only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to furnish any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claim by you or any third party relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that the app infringes that party's intellectual property rights.
• You represent that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.

13 · Google Play

If you obtained weatherbox from Google Play, your use is also subject to the Google Play Terms of Service. These terms are between you and cineviv only. Google is not a party to them and is not responsible for the app.

14 · termination

This licence continues until terminated. It ends automatically if you breach these terms, and you may end it at any time by uninstalling the app. Sections 4, 7, 9, 10 and 11 survive termination.

15 · changes to these terms

We may update these terms. We will update this page and the date at the top when we do. Continuing to use the app after a change means you accept the revised terms. If you do not accept them, uninstall the app.

16 · governing law

These terms are governed by the laws of California, United States, without regard to its conflict-of-laws rules, and the courts of California, United States will have exclusive jurisdiction over any dispute. This does not deprive you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings there where that law gives you it.

17 · entire agreement

These terms and the Privacy Policy are the entire agreement between you and us regarding the app. If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.
